Kabisa Terms of Use

These Terms of Use (the "Terms") are an agreement between you and Kabisa Electric Ltd., trading as Kabisa ("Kabisa", "we", "us"), Company ID 120732779, registered at Kabisa EV House, 1 KN 77 St, Kiyovu (below Camp Kigali), Kigali, Rwanda. In Kenya, the Services are operated by our regional expansion entity, Kabisa Kenya, of Golf View Offices, Nairobi, Kenya. They govern your use of:
- the Kabisa consumer app (mobile and web);
- the Kabisa fleet app;
- the Kabisa CPMS ("Charge Point Management System") console used by our staff and station-operator partners;
- the gokabisa.com website;
together with our electric-vehicle charging network (together, the "Services").
By creating an account or using the Services you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you access the CPMS as Kabisa staff or a station-operator partner, your use is also governed by your employment agreement or operator contract, which takes priority over these Terms for anything they conflict on.
1. The Services
Kabisa operates an EV charging network in Rwanda and Kenya. Through the App you can find charging stations, see live availability and pricing, start and stop charging sessions, pay for them, manage a wallet, and (for fleets) manage vehicles and drivers. Some stations on the map may be operated by roaming partners rather than by Kabisa; sessions on partner stations are still billed through your Kabisa account.
2. Your account
- You must be at least 18 years old and able to enter a binding contract.
- Keep your sign-in credentials, device, and payment PIN secure. You are responsible for activity on your account unless it results from our fault. Tell us immediately at [email protected] if you suspect unauthorised use.
- The information you give us (name, phone number, vehicle details, number plate) must be accurate and kept up to date. Charging tags (RFID) and AutoCharge vehicle identifiers linked to your account are yours to use and can be revoked by you in the App at any time.
- Fleet accounts: if your account is enrolled in a fleet, your fleet manager controls vehicle assignments and receives the fleet's usage and billing data, and consolidated billing may go to the fleet owner rather than to you.
3. Charging
- Follow the instructions at the station and use equipment only as intended. Do not use adapters or cables that are damaged or not approved for the connector.
- Park only while charging, in bays marked for charging. We may apply an idle fee (displayed in the App before you start) if your vehicle remains connected after charging completes, to keep chargers available.
- Availability shown in the App is live but not guaranteed — a station can become occupied or go out of service before you arrive.
- You are responsible for ensuring your vehicle is compatible with the connector you select.
- Some stations have access restrictions (e.g. a host's own membership, or reserved use by a specific fleet or vehicle brand) — these are shown in the App, but the site is still shown on the map so you can plan around it.
- Reporting stations: you can report a station as offline/unavailable or suggest a correction to its listed information (and optionally attach a photo) in the App. Reports and suggested corrections are reviewed by our staff before anything changes on the listing — submitting one doesn't itself alter a station's information. If a station gets multiple offline reports in a short period, we may temporarily mark it unavailable in the App until we confirm its status. Don't submit false or misleading reports.
4. Prices and payment
- Prices are shown in the App before you start a session — typically per kWh, and where indicated per minute or per session, including applicable taxes. The price shown when you start a session is the price you pay for it.
- You pay through the payment methods offered in the App — currently mobile money (e.g. MTN Mobile Money in Rwanda, M-Pesa in Kenya) and a prepaid Kabisa wallet funded by mobile-money top-ups. Payment is authorised on your phone with your provider; we never ask for your mobile-money PIN.
- Wallet balances are prepayments for charging, are not a bank deposit, earn no interest, and are refundable on request at account closure less amounts you owe.
- A receipt for each session is available in the App. In Rwanda, invoices are issued in accordance with RRA e-invoicing (EBM) requirements.
- If a payment fails or a session cannot be billed, we may suspend charging on your account until the balance is settled.
- Obvious pricing errors do not bind us; if you were charged under an obviously wrong price we will correct the charge and tell you.
5. Acceptable use
You must not:
- use the Services unlawfully, or resell charging without our written agreement;
- interfere with, damage, or attempt to bypass payment on chargers, the App, or the network (including probing, scraping at scale, or reverse engineering except where the law permits it);
- use another person's account or charging tag without authorisation;
- block charging bays or endanger others at a station.
We may suspend or terminate accounts that break these Terms, put safety at risk, or are involved in fraud — where practical we will warn you first.
6. Availability and changes
We work to keep the network and App available but do not promise uninterrupted service; stations need maintenance and networks fail. We may change, add, or withdraw features, stations, or tariffs. Tariff changes never affect a session already in progress.
7. Liability
- Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by our negligence, or your statutory consumer rights in Rwanda or Kenya.
- Otherwise, our total liability to you for claims arising in any 12-month period is limited to the greater of the amounts you paid us in that period or [LIABILITY CAP, e.g. RWF 500,000].
- We are not liable for damage caused by your own equipment or vehicle fault, use of the equipment contrary to instructions, events outside our reasonable control (e.g. grid outages), or indirect losses such as lost profits or lost time.
- Charging involves high-voltage equipment: report damaged equipment via the App or [email protected] and never use a visibly damaged charger.
8. Ending the agreement
You may stop using the Services and delete your account at any time in the App or at gokabisa.com/delete-account. Amounts already owed remain payable; remaining wallet balance is refunded per section 4. We may close accounts that have been inactive for over [24 months] after notifying you and refunding any balance.
9. Intellectual property
The App, website, brand, and content are Kabisa's or our licensors' property. We grant you a personal, non-transferable licence to use the App to access the Services. You may not copy, modify, or distribute them except as the law allows.
10. Changes to these Terms
We may update these Terms. For material changes we will give you notice in the App or by message at least [14 days] before they take effect; continuing to use the Services after that date means you accept the new Terms. If you do not accept them, close your account before they take effect.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Rwanda. If you use the Services in Kenya, mandatory Kenyan consumer-protection rules still apply to you. Contact [email protected] first — most issues are resolved quickly. Disputes that cannot be resolved amicably go to the competent courts of Kigali, Rwanda, unless mandatory law gives you the right to your local courts.
